Limitation of liability regarding tracking data and the use of Sweel reports

Distances, durations and trips recorded by the Sweel application are calculated from GPS data and mobile device sensors. These measurements are provided for indicative purposes only. Discrepancies may occur due to GPS signal accuracy, environmental conditions (dense urban areas, tunnels, interference), battery status or hardware quality. It is the user's responsibility to verify the accuracy of the data before any official or declaratory use.
Sweel is a mileage tracking tool. The reports generated by the application (PDF, XLS, CSV) are personal and professional documentation aids. They do not in any way constitute tax, accounting or legal advice. For questions regarding the tax deductibility of cycling allowances, reimbursement of travel expenses or any other regulatory aspect, we recommend consulting a qualified tax advisor or accountant, or referring to official publications from the Belgian tax authority (SPF Finances / FOD Financiën).
The user is solely responsible for the use of data and reports generated by Sweel, particularly in the context of tax declarations, expense reimbursement requests or any communication to an employer, administration or third party. It is the user's responsibility to verify the accuracy and completeness of the data before any submission or official use.
The quality of GPS tracking may be affected by numerous factors beyond Sweel SRL's control:
Sweel SRL does not guarantee 100% GPS accuracy and accepts no liability for measurement discrepancies resulting from these factors.
The Sweel service is provided "as is" and "as available". Sweel SRL does not guarantee that the service will be available without interruption, error-free or free from viruses. Service interruptions may occur due to maintenance, updates or technical incidents. The availability of integrations with third-party services (Apple Health, Google Health Connect, Strava, Garmin) depends on the policies and availability of those services, over which Sweel SRL has no control.
To the extent permitted by applicable Belgian law, Sweel SRL shall not be liable for indirect, incidental, consequential or punitive damages arising from the use of or inability to use the service, including in particular loss of data, revenue or business opportunities. This limitation does not apply in the event of fraud, gross negligence on the part of Sweel SRL, or harm to the physical integrity of a person.
