Terms of Service

1. Purpose

These Terms of Service (ToS) govern access to and use of the Sweel mobile application, published by Sweel SRL (BCE 0696.843.347, Chaussée de Vleurgat 15, 1050 Brussels, Belgium). The Sweel application enables automatic tracking of cycling trips and the generation of mileage reports. By creating an account or using the application, you unconditionally accept these Terms of Service.

2. User Account

To access Sweel's features, you must create an account by providing accurate, complete and up-to-date information. You are solely responsible for the confidentiality of your login credentials and all activities carried out from your account. You agree to notify Sweel immediately in the event of any unauthorised use of your account. Use of the application is restricted to persons aged 16 or over.

3. Subscriptions

The Sweel application offers premium features accessible via subscription. Subscriptions are managed and billed exclusively through the Apple App Store or Google Play Store depending on your device.

• Payment: payment is charged to your Apple or Google account upon purchase confirmation.
• Automatic renewal: subscriptions renew automatically at the end of each period unless the renewal is disabled at least 24 hours before the end of the current period.
• Management: you can manage your subscription and disable automatic renewal from your Apple or Google account settings.
• Refunds: refund requests are handled in accordance with Apple's and Google's policies. Sweel SRL does not process direct refunds for purchases made through the stores.

4. Account Deletion

You may request deletion of your account at any time from the application settings or by sending an email to privacy@sweel.com. Deletion results in the erasure of your personal data, except data whose retention is required by a legal obligation. Deleting your account does not automatically cancel an active subscription; you must cancel your subscription separately through the App Store or Google Play.

5. Liability

Distances and durations recorded by Sweel are provided for indicative purposes and may differ from reality due to GPS conditions. Sweel does not provide tax, accounting or legal advice; the generated reports are tracking tools and do not constitute legal proof in themselves. The service is provided "as is" and Sweel SRL does not guarantee uninterrupted or error-free operation. Sweel SRL's liability is limited to proven direct damages and does not cover indirect or consequential damages.

6. Intellectual Property

All elements of the Sweel application (source code, design, texts, logos, trademarks, icons) are the exclusive property of Sweel SRL and are protected by intellectual property laws. You are granted a personal, non-exclusive and non-transferable right of use. Any unauthorised copying, reproduction, decompilation, modification or distribution is strictly prohibited.

7. Amendments to the ToS

Sweel SRL reserves the right to amend these Terms of Service at any time. In the event of a substantial change, you will be notified by email or via a notification in the application. Continued use of the application after notification constitutes acceptance of the new Terms of Service.

8. Governing Law and Jurisdiction

These Terms of Service are governed by Belgian law. In the event of a dispute, and failing an amicable resolution, the courts of Brussels shall have exclusive jurisdiction.
